Partiendo de la hipótesis de que el momento constitucional ecuatoriano conjuga dos perspectivas jurídicas antagónicas: el positivismo jurídico y el enfoque iusnaturalista, el autor sostiene que para evitar la adopción de modelos extranjeros a la realidad jurídica y social de su país, tiene que discutirse primero el concepto
de derecho y su significación cultural. Reflexiona sobre el papel protagónico que el
positivismo jurídico tuvo a lo largo del siglo xx en Ecuador, con el objeto de discutirlo, repensarlo y concederle el lugar que merece.
