At first, a legislative legal analysis of the institution under study is carried out based on the elements of the legal relationship, from the Oaxacan civil codification of 1827, up to the current federal civil codification of 1928. In a second moment, a performs an analysis of parental authority, its regulation in the legal system and in the doctrinal field. Thirdly, the incidence of the best interest of children and adolescents in the figure of parental authority is identified, which is reconside- red from the perspective of parental responsibility, both internationally and in Mexican jurisprudence. Finally, it is proposed to change from a nineteenth-century denomination and conception to one that considers the best interest of the minor.
