Approach to the legal framework of civil mediation in the State of Puebla

Abstract

This article analyzes the legal framework of mediation
in civil matters in the State of Puebla, in the period from
2015 to 2019. Said analysis begins with a conceptual
review of mediation in civil cases. In addition to the
above, civil mediation is studied from two perspectives,
a legal one based on the Puebla legislative framework,
as well as the legislation that regulates the Alternative
Justice Center. The other perspective attends to the
quantitative scope of civil mediation derived from the
statistics of the State Judicial Power and the National
Institute of Statistics, Geography and Informatics. It
is concluded that civil mediation in Puebla is carried
out through the Alternative Justice Center, which has
parts, procedures and specific aspects contemplated in
the adjective civil code, the law and regulations of said
center; In addition to the fact that it is identified that
it is a mechanism that is not widely used compared to
the number of first instance trials that are presented
annually in civil and family matters before the Judicial
Power of the State of Puebla.
