The need to apply conventionality control in the prohibition of resorting to restorative justice in the crime of family violence

Abstract

Our papper defends the position that criminal judges
carry out conventional interpretation, and therefore
conventionality control, taking into account the United
Nations resolutions where the human right of the
crime victim to access alternative dispute resolution
mechanisms has been recognized, such as mediation
or conciliation, so that those involved (victim and
aggressor) of the crime of family violence go to the
restorative justice centers and if an agreement is
reached, it is submitted to the judicial approval
procedure and at the time it is declared the extinction
of the criminal action.
