Artificial intelligence and the protection of neuro-genomic heritage: Towards ethical regulation in the face of the new challenges to the rule of law

Authors

Abstract

This scientific article analyzes the disruptive convergence between Artificial Intelligence (AI) and contemporary biojurisprudence, focusing on the urgent need to protect the individual’s neurogenomic heritage. Through an analyticaldeductive method and a systematic review of international scholarship and Mexico’s constitutional framework, it examines how the processing of massive biological data by deeplearning algorithms undermines traditional pillars of the rule of law, such as autonomy of the will and the free development of personality. The research findings show that the current personaldata protection framework is insufficient in light of AI’s capacity for reidentification and prediction. It con???? cludes by proposing that neurorights be elevated to the status of fundamental guarantees, ensuring ethical governance that prevents biological????digital determinism and safeguards human dignity as the guiding principle of technological innovation.
