Abstract

This article analyses the right not to be discriminated against in the exercise of the fundamental right to religious freedom in the case of public servants. It reviews the provisions contained in international and regional Declarations and Conventions; it describes some cases of discrimination against public servants in accordance with judicial resolutions; it analyses the typology of relations between the State and religions; and it mentions some examples of cooperation between them. It concludes that the full exercise of religious freedom by public servants will depend largely on the regime of relations between the State and religions or churches, the ideal being a regime of collaboration or fruitful interrelations between the State and religions, for a better exercise of the fundamental right to religious freedom of every person, including public servants.
