Reflections on Toulmin's argumentation model and its methodological, heuristic, educational and accountability advantages based on its application to three judicial cases

Abstract

In this paper, Toulmin's argumentative model is applied to three cases from the Mexican judicial system to note its argumentative usefulness; especially, the model is a valuable tool to analyze, represent and evaluate the arguments that judges use to justify their decisions, but its benefits are also reflected in suggesting argumentative actions to improve jurisdictional work. However, other areas are explored here in which the advantages of the model are also significant, especially if it is configured (1) as a methodological strategy, (2) as a heuristic tool, (3) as educational material, and (4) as a mechanism for judicial accountability and access to justice.
