Special indigenous jurisdiction applicable to adolescents in conflict with criminal law in Mexico

Abstract

The National Code of Criminal Procedures establishes the possibility that in certain cases, adults belonging to indigenous peoples and communities who violate the criminal order, be judged in a special procedure by the original authorities themselves. For its part, justice for adolescents in conflict with criminal law, has been built based on its own principles and on the subject, the corresponding national legislation does not expressly contemplate the possibility of its application. For these reasons, this article focuses on establishing the reasons why it is necessary for the special indigenous jurisdiction to operate in certain cases in the case of adolescents in conflict with criminal law, from a human rights perspective, for which it is used documentary methodology.
